A office or post mentioned in the constitution is a Constitutional Post. Thus, Constitutional Posts are those State functionaries who derive their existence and powers directly from the Constitution. The Constitutional posts consist of President, Vice President, Governor, Judges of Supreme Court and High Court, Prime Minister, Chief Minister, Comptroller and Auditor General of India, Attorney General of India etc.
The President of India holds the power to make numerous constitutional appointments. However, the power is exercised on the proposal of the Cabinet. Cabinet decides who is to be appointed and the place to be appointed to. The President appoints Governor of States, ambassadors and members of a number of Commissions. The Constitutional Bodies in India are created by the Constitution which assists the Government to operate properly. Each of these permanent or semi-permanent organizations is accountable for the administration of specific functions. Some additional bodies help them by providing advisory functions. The major constitutional bodies in India are as under:
  • Union Public Service Commission (UPSC)
  • State Public Service Commission
  • Joint State Public Service Commission
  • The Comptroller and Auditor General of India
  • Election Commission of India
  • Finance Commission of India
  • National Commission for Scheduled Castes (NCSC)
  • National Commission For Scheduled Tribe
  • Staff Selection Commission (SSC)
  • Central Vigilance Commission (CVC)

  • The Union Council of Ministers exercises executive authority in the Republic of India. The Union Council of Ministers consists of senior ministers, called 'cabinet ministers', junior ministers, called 'ministers of state' and, rarely, deputy ministers.
    The Union Council of Ministers is led by the Prime Minister. A smaller executive body called the Union Cabinet is the supreme decision-making body in India. Only the prime minister and ministers of the rank of cabinet minister are members of Union Cabinet. The Council of Ministers is responsible collectively to the lower house of the Indian parliament, called the Lok Sabha (House of People). A minister shall not take any decision without being considered by the council of ministers. All union cabinet members shall submit in writing to the President to propose proclamation of emergency by the president.
    According to the Constitution of India, the total number of ministers in the council of ministers must not exceed 15% of the total number of members of the Lok Sabha. Ministers must be members of parliament. Any minister who is not a member of either of the houses of the parliament for six consecutive months is automatically stripped off his or her ministerial post. There are five categories of council of ministers as mentioned below:
  • Prime Minister
  • Deputy Prime Minister (if any); presides as prime minister in his absence or as the senior most cabinet minister.
  • Cabinet Minister: member of cabinet; leads a ministry.
  • Minister of State (independent charge): junior minister not reporting to a cabinet minister.
  • Minister of State (MoS): junior minister reporting to a cabinet minister, usually tasked with a specific responsibility in that ministry.
